vii.theGoodshavebeenassembledorincorporatedintoother

goodsonlyinaccordancewithanyinstructionsissuedbythe

Company;

viii.thedefecthasnotarisenfromadesignmodifiedbythe

Purchaser;

ix.thedefecthasnotarisenfromanitemmanufacturedbyaperson

otherthantheCompany.Inrespectofanyitemmanufacturedby

apersonotherthantheCompany,thePurchasershallonlybe

entitledtothebenefitofanywarrantyorguaranteeprovidedby

suchmanufacturertotheCompany.

b.InrespectofcomputersoftwaresuppliedbytheCompanythe

Companydoesnotwarrantthattheuseofthesoftwarewillbe

uninterruptedorerrorfree.

c.TheCompanyacceptsliability:

(i)fordeathorpersonalinjurytotheextentthatitresultsfrom

thenegligenceoftheCompany,itsemployees(whilstinthe

courseoftheiremployment)oritsagents(inthecourseofthe

agency);

(ii)foranybreachbytheCompanyofanystatutoryundertaking

astotitle,quietpossessionandfreedomfromencumbrance.

d.Subjecttoconditions(a)and(c)fromthetimeofdespatchofthe

GoodsfromtheCompany’spremisesthePurchasershallbe

responsibleforanydefectintheGoodsorloss,damage,nuisanceor

interferencewhatsoeverconsequentialeconomicorotherwiseor

wastageofmaterialresultingfromorcausedbyortotheGoods.In

particulartheCompanyshallnotbeliableforanylossofprofitsor

othereconomiclosses.TheCompanyaccordinglyexcludesallliability

forthesame.

e.AttherequestandexpenseofthePurchasertheCompanywilltestthe

Goodstoascertainperformancelevelsandprovideareportofthe

resultsofthattest.Thereportwillbeaccurateatthetimeofthetest,

tothebestofthebeliefandknowledgeoftheCompany,andthe

Companyacceptsnoliabilityinrespectofitsaccuracybeyondthatset

outinCondition(a).

f.SubjecttoCondition(e)norepresentation,condition,warrantyor

otherterm,expressorimplied(bystatuteorotherwise)isgivenbythe

CompanythattheGoodsareofanyparticularqualityorstandardor

willenablethePurchasertoattainanyparticularperformanceor

result,orwillbesuitableforanyparticularpurposeoruseunder

specificconditionsorwillprovideanyparticularcapacity,

notwithstandingthattherequirementforsuchperformance,resultor

capacityorthatsuchparticularpurposeorconditionsmayhavebeen

known(oroughttohavebeenknown)totheCompany,itsemployees

oragents.

ProductWarranty-2YearExtended

Asstandard,Sonifexproductsaresuppliedwitha1yearbacktobase

warranty.Inordertoregisterthedateofpurchaseandsothatwecankeep

youinformedofanyproductdesignimprovementsormodifications,itis

importanttocompletethewarrantyregistrationonline.Additionally,ifyou

registertheproductontheSonifexwebsite,youcanincreaseyourproduct

1.Definitions

‘theCompany’meansSonifexLtdandwhererelevantincludescompanies

withinthesamegroupofcompaniesasSonifexLimited.

‘theGoods’meansthegoodsoranypartthereofsuppliedbytheCompany

andwhererelevantincludes:workcarriedoutbytheCompanyonitems

suppliedbythePurchaser;servicessuppliedbytheCompany;andsoftware

suppliedbytheCompany.

‘thePurchaser’meansthepersonororganisationwhobuysorhasagreedto

buytheGoods.

‘thePrice’meansthePriceoftheGoodsandanyotherchargesincurredby

theCompanyinthesupplyoftheGoods.

‘theWarrantyTerm’isthelengthoftheproductwarrantywhichisusually12

monthsfromthedateofdespatch;exceptwhentheproducthasbeen

registeredattheSonifexwebsitewhentheWarrantyTermis24monthsfrom

thedateofdespatch.

‘theContract’meansthequotation,theseConditionsofSaleandanyother

documentincorporatedinacontractbetweentheCompanyandthe

Purchaser.

ThisistheentireContractbetweenthepartiesrelatingtothesubjectmatter

hereofandmaynotbechangedorterminatedexceptinwritingin

accordancewiththeprovisionsofthisContract.Areferencetotheconsent,

acknowledgement,authorityoragreementoftheCompanymeansinwriting

andonlybyadirectoroftheCompany.

2.Warranty

a.TheCompanyagreestorepairor(atitsdiscretion)replaceGoods

whicharefoundtobedefective(fairwearandtearexcepted)and

whicharereturnedtotheCompanywithintheWarrantyTermprovided

thateachofthefollowingaresatisfied:

i.notificationofanydefectisgiventotheCompanyimmediately

uponitsbecomingapparenttothePurchaser;

g.(i)TotheextentthattheCompanyisheldlegallyliabletothe

Purchaserforanysinglebreachofcontract,tort,representation

orotheractordefault,theCompany’sliabilityforthesameshall

notexceedthepriceoftheGoods.

(ii)TherestrictionofliabilityinCondition(g)(i)shallnotapplytoany

liabilityacceptedbytheSellerinCondition(c).

h.WheretheGoodsaresoldunderaconsumertransaction(asdefinedby

theConsumerTransactions(RestrictionsonStatements)Order1976)

thestatutoryrightsofthePurchaserarenotaffectedbythese

ConditionsofSale.

UnpackingYourProduct

Eachproductisshippedinprotectivepackagingandshouldbeinspectedfor

damagebeforeuse.Ifthereisanytransitdamagetakepicturesofthe

productpackagingandnotifythecarrierimmediatelywithalltherelevant

detailsoftheshipment.Packingmaterialsshouldbekeptforinspectionand

alsoforiftheproductneedstobereturned.

Theproductisshippedwiththefollowingequipmentsopleasecheckto

ensurethatyouhavealloftheitemsbelow.Ifanythingismissing,please

tominimisetheimpactsofelectricalandelectronicequipmentonthe

environmentduringtheirlifetimesandwhentheybecomewaste.All

onthecase.SonifexLtdwillbehappytogiveyouinformationaboutlocal

organisationsthatcanreprocesstheproductwhenitreachesits“endofuse”,

toSonifexandwillbereprocessedcorrectlyfreeofcharge.
